In Illinois, leaving the scene of an accident is a crime punishable by law. These situations are known as hit and run accidents-where one driver involved in the incident leaves the scene before sharing his or her insurance and license information. There are several reasons why drivers choose to leave the scene of the accident but it is almost always connected with a fear of being blamed for a wrongdoing.

Fleeing the Scene: It's Against the Law

As mentioned before, leaving the scene of an accident is in violation of Illinois state law, specifically Illinois Vehicle Code Sec. 11-401 (a). Drivers who flee the accident usually do so because they wish to avoid contact with law enforcement. This could be because they lack insurance coverage, are already in trouble with the law, or lack proper documentation to drive/live in Illinois. Others may rush away in a panic because their insurance coverage is inadequate to compensate the damage they caused.

Fortunately, a majority of hit and run drivers are eventually found since their automobiles can be identified, especially by the signs of collision and damage. Regardless, the victim of the accident still deserves to be compensated. Most insurance policies include what is known as uninsured/underinsured motorist coverage (UM / UIM). This is a clause within your own insurance company's policy that covers your damage needs in the event that the other driver flees or fails to cover them with his or her own insurance policy.
